Florida Highway Patrol Captain Arrested For Child Porn

Police officers and other law enforcement officials have a duty to protect and serve their communities. This includes protecting children and keeping them safe, so when a highway patrol captain is arrested for child porn, it can send shock waves through a community.

A 45-year-old Florida Highway Patrol captain from Broward County has been arrested for viewing child pornography. The admired and respected man is facing at least one charge for intending to view child porn.

No details have been released about what exactly happened, but the captain was arrested and has already appeared in court. He is no longer employed by the Florida Highway Patrol. He was part of Troop L, which consisted of Fort Pierce, Lake Worth, and Davie.

The man was arrested by the U.S. Marshals, which means he will face criminal charges in federal court. He is currently in Broward County Jail. No bond has been set.

Possession of Child Porn Material With the Intent to View

Crimes involving possession of child porn material with the intent to view is a felony offense that can result in at least 10 years in prison. This involves the control or possession of indecent material of a child under the age of 18. If the victim is a minor under the age of 12, the penalty can increase to 20 years in prison.

Keep in mind that a person can face conviction only if they knowingly and intentionally possessed or accessed the sexually explicit images fully knowing that the subject was a minor under the age of 18. Also, if the offender had a previous conviction for a sex offense, they could face up to 20 years in prison, regardless of the child’s age.

It should be noted that although there are no minimum penalties for possession of child porn, the minimum sentence is usually set at 10 years. Therefore, you should not plead guilty to a child porn crime unless you are fully aware of this.

Sexually explicit materials may include indecent images or videos depicting a minor child. These could be photos, videos, exhibitions, or other presentations showing a child in a sexual pose. The images must depict sexual conduct, which may consist of sexual activities, physical contact with a minor, or a display of sexual organs, such as the genitals, pubic area, buttocks, or female breasts.

Under Florida state law, each image of child porn is treated as a separate crime, which is why those charged with this crime can face hundreds of counts of child pornography possession.
