Man Re-Arrested After Committing Child Porn Offenses

After being released from jail, a person may be re-arrested even if they have not committed another crime. It’s possible for law enforcement official and judges to change their minds about a situation

A 19-year-old Florida man has been arrested again after he was released a month ago. He was just released in October, but a judge decided he needed to be arrested again for posing a danger to the community.

The man, from DeLand, was originally arrested on October 16. He was charged with 30 counts of child pornography possession. The Volusia County Sheriff’s Office began investigating the man after receiving a tip about him having explicit images and videos of children on his cell phone.

The man was released from jail after posting bail. According to the State Attorney’s Office, though, the man was a danger to the community. A judge agreed, and the man was arrested again just two weeks later.

Court records for the man’s case remain sealed. However, a motion regarding pre-trial detention was filed on October 27. A motion to amend it was filed on October 1.

The man will remain at the Volusia County Branch Jail without bond. He will stay in jail as he awaits trial. In addition to the child porn charges, the sheriff’s office suspects that the man is molesting children. Any victims should contact the Volusia County Sheriff’s Office Child Exploitation Unit.

When a Person is a Danger to Others

There may be cases such as this where a person is arrested and released but then arrested again because the person is considered to be a danger to the community and others. The danger that an alleged offender poses to the community is something that may be addressed in Florida courts.

Law enforcement officials may determine this based on the person’s previous actions such as recent violent acts or threats of violence or by placing others in reasonable fear of harm.

Some things that courts and police will look at to determine if a person is dangerous include the following:

  • The nature and circumstances of the violation
  • Any new criminal offenses charged
  • Any arrests without conviction for violent or sexual crimes
  • The alleged offender’s past and present conduct
  • Any other evidence of allegations of unlawful sexual conduct or the use of violence
  • The alleged offender’s employment history and mental condition
  • The alleged offender’s family ties and length of residence in the community
  • Their history and conduct during probation
  • The likelihood that the alleged offender will reoffend
  • The evidence against the alleged offender
